2. Use of the service

2.1 Licence of use

You are granted a limited, non-exclusive, non-transferable and revocable licence to access and use our services solely for personal, non-commercial purposes. This licence does not confer on you any ownership right over the content, software or services of the website.

2.2 Restrictions

You undertake not to use the service for unlawful or unauthorised purposes or in breach of these terms. Specifically, you must not attempt to gain unauthorised access to our systems, servers or networks connected to the website. Interfering with or disrupting the operation of the service or the servers hosting it is prohibited. You may not copy, modify, distribute, sell or lease any part of our services or content without express authorisation. The use of bots, scrapers, crawlers or any automated tool to access the website without our prior written consent is likewise not permitted. Finally, you must not publish or transmit false, misleading or defamatory information, or information that infringes the rights of third parties.

3. Account registration

To access certain advanced features of our website, it may be necessary to create a user account. On registering, you undertake to provide accurate, complete and up-to-date information about your identity. It is your responsibility to keep your access credentials confidential, including your username and password. You are solely responsible for all activity carried out under your account, whether or not authorised by you. If you detect any unauthorised use of your account or any other security breach, you must notify us immediately so that we can take appropriate action. We reserve the right to suspend or cancel accounts that breach these terms or that are used fraudulently.

4. User content

4.1 Responsibility

You are solely responsible for the content you publish, submit or transmit through our website, including but not limited to comments, reviews, enquiries, images and any other type of information. You must ensure that all content you publish complies with these terms and with applicable law, and that it does not infringe the rights of third parties.

4.2 Content licence

By publishing content on our website, you automatically grant us a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display that content in any medium and format, in connection with the provision and promotion of our services. This licence continues even after you stop using our services, although you may request the removal of your content at any time.

5. Property information

Asif Grup acts as a property intermediary and endeavours to provide accurate, up-to-date and complete information about the properties shown on its website. However, all information is provided "as is" and "as available", without warranties of any kind, whether express or implied. Prices, floor areas, features, planning status and availability of properties are subject to change without notice and must be confirmed with Asif Grup before any reservation, offer or signature. Photographs, floor plans and visual representations are illustrative only and may not reflect the exact current state of the property. Descriptions and measurements are approximate. We strongly recommend that users verify all information independently, consult the Land Registry and cadastral documentation, and carry out whatever inspections they consider necessary before making any purchase, rental or investment decision. Asif Grup accepts no liability for inaccuracies, errors or omissions in property information supplied by third parties (owners, managers, homeowners' associations, etc.).

6. Third-party services

Our website may contain links, references or integrations with third-party websites, services or applications. These links are provided for your convenience only and do not imply any endorsement, approval or verification by us of the content or services of those third parties. We are not responsible for the content, privacy policies, practices or availability of third-party websites or services. Access to and use of any third-party website or service is subject to that third party's own terms and conditions and privacy policies. You acknowledge and accept that we will not be liable, directly or indirectly, for any damage or loss caused or allegedly caused by or in connection with the use of any content, goods or services available on or through such third-party websites or services.

7. Intellectual property

All website content, including but not limited to text, graphics, logos, icons, images, photographs, videos, audio clips, software, source code, graphic design, and the structure and organisation of the site, is the exclusive property of Antonia Pedragosa Vernet (Asif Grup) or of its licensors and is protected by national and international intellectual and industrial property law.

All intellectual property rights are reserved. You are granted no right or licence over the website content beyond what is necessary for personal, non-commercial use of the site. The reproduction, distribution, modification, public display or any other form of exploitation of the content without our prior written consent is strictly prohibited. Any unauthorised use of the content may constitute a breach of copyright, trade mark and other applicable laws.

8. Limitation of liability

To the fullest extent permitted by applicable law, we do not warrant that the service will be uninterrupted, timely, secure or error-free. The website and all services are provided "as is" and "as available". We are not liable for any direct, indirect, incidental, special, consequential or punitive damage arising from the use of, or inability to use, our services, including but not limited to loss of profits, loss of data, business interruption or any other commercial loss. We do not warrant the accuracy, completeness, reliability or currency of the information provided through the website. In any event, our total aggregate liability to you for all claims relating to the service will not exceed the total amount you have paid us for the services during the twelve months preceding the claim, or one hundred euros if you have made no payment.

9. Indemnity

You agree to indemnify, defend and hold harmless Antonia Pedragosa Vernet (Asif Grup), as well as her collaborators, agents and suppliers, against any claim, demand, damage, loss, liability, cost and expense, including reasonable legal fees, arising out of or relating to your use of the service, your breach of these terms and conditions, your infringement of any third-party right, or any content you publish or transmit through the website. This indemnity obligation will survive the termination of these terms and of your use of the service. We reserve the right to assume the exclusive defence and control of any matter subject to indemnity by you, in which case you will cooperate fully with us in the defence of that claim.

10. Changes to the service

We reserve the right to modify, suspend, discontinue or restrict any part of the service, temporarily or permanently, at any time and without prior notice. This includes the possibility of changing the features of the service, adding new functionality, removing existing features or altering the technical requirements needed to access the service. We will not be liable to you or to third parties for any modification, suspension or discontinuation of the service, even if that change results in the loss of content or functionality. We recommend that you review these terms and the website regularly to stay informed of any changes to the service.

11. Termination

We may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these terms and conditions. Grounds for termination may include requests from legal or governmental authorities, fraudulent or unlawful activity detected on your account, behaviour that harms or damages other users or the reputation of the service, or any other conduct we consider inappropriate or harmful. Following termination, your right to use the service will cease immediately and we may delete or deactivate your account and all associated content. Provisions of these terms that by their nature should survive termination, including but not limited to those on intellectual property, limitation of liability and indemnity, will remain in force after termination.

12. Governing law and jurisdiction

These terms and conditions are governed by, construed and enforced in accordance with the laws of the Kingdom of Spain, without giving effect to any conflict-of-laws principles. Any dispute, controversy or claim arising out of or relating to these terms, or to their breach, termination or validity, will be subject to the exclusive jurisdiction of the Courts and Tribunals of Barcelona, Spain. You expressly waive any other jurisdiction to which you might be entitled by reason of your present or future domicile.

13. Dispute resolution

Should any dispute, controversy or disagreement arise in relation to these terms or to the use of the service, the parties undertake to attempt to resolve it in the first instance through direct, good-faith negotiation. Both parties will make reasonable efforts to reach an amicable solution over a period of thirty days from the moment one party notifies the other of the existence of the dispute. If no satisfactory resolution is reached within that period, the parties may submit the dispute to mediation before commencing any legal action. Only if mediation is unsuccessful or not possible may the parties bring the matter before the competent courts as set out in the jurisdiction clause.

14. Severability

If any provision of these terms and conditions is declared invalid, unlawful or unenforceable by a competent court, that provision will be deemed severable from the remainder of the terms and will not affect the validity and enforceability of the remaining provisions. In such a case, the parties agree that the court should endeavour to give effect to the parties' intentions as reflected in the invalid provision, and the other provisions of these terms will remain in full force and effect. This severability clause will apply to the fullest extent permitted by applicable law.
